When is not allowed to intervene?

When a legitimate interest is not existent or the interested party has not been determined. He may neither intervene when bad faith is evident or in case abusive use is made of the administrative procedure, with the intention to disturb the public administration.
The citizenship ombudsman may not intervene when the complaints are related to the area of competence of the European ombudsman, to the ombudsman or to the "trustee for tort" of this autonomous community.
Furthermore, he will neither intervene in any case that is familiar to any court or tribunal. In case any court or tribunal intervenes after the the citizenship ombudsman has already initiated his actions, he will have to suspend immediately any administrative procedure or action he may have initiated.
